In the city of Nakhodka on the materials of the Prosecutor\’s investigation, the criminal case against an officer of the service of judicial bailiffs. As has told to the correspondent of RIA «VladNews» senior assistant Prosecutor of Primorsky Krai Elena Telegina, the Prosecutor\’s office of the city of Nakhodka check of observance of the legislation on enforcement proceedings by the Department of court bailiffs of Nakhodka city district. In the course of Supervisory activities is established that the bailiff BSA Nakhodka in December 2012 completed a number of Executive proceedings on alimony on the grounds stipulated by p. 1 tsp 1 tbsp 46 of the Federal law «On enforcement proceedings», i.e. the application of a creditor. Meanwhile, it was found that the plaintiffs such statements were not served. At the moment of termination of Executive proceedings owe alimony payments amounted to over 600 thousand rubles. Given these circumstances indicating signs of malfeasance, public Prosecutor sent the materials of the inspection to the investigating authorities to address the issue of criminal prosecution. Based on this consideration, the investigative Department of the SU TFR for the Primorsky Krai June 192013 the criminal case against the bailiff to the BSA Nakhodka on the grounds of crimes, stipulated by H. 1 tbsp. 285 of the criminal code (abuse of power) and H. 2 tbsp. 292 of the criminal code (forgery).
