At the meeting of the Committee ЗСПК considered the issue «On circulation of the Vladivostok city Duma on regulation of the procedure for approval of reconstruction and rearrangement of non-residential premises located in the housing stock of Primorsky Krai and municipal housing stock, as well as defining the powers of local authorities in matters of conversion or alterations to non-residential premises in apartment buildings». A report on this issue made by the Chairman of the Vladivostok city Duma Elena Novitskaya. In her speech she stressed the need for the adoption of the Law of the Primorsky territory, providing for the procedure of approval of restructuring and conversion of non-residential premises in apartment buildings. «As known, the first and basement floors in apartment buildings are often used for shops and offices. These rooms are a serious restructuring and reorganization. Lack of control of these processes can lead to violations of bearing constructions, engineering equipment and ultimately to a violation of the reliability of dwelling houses. Meanwhile, at the present time, the redevelopment of non-residential premises in residential buildings is not regulated by any normative act, either at the Federal level nor at the level of subject of the Russian Federation. Municipal legal acts of this issue cannot be settled, because the normative regulation in this area is not within the competence of the bodies of local self-government. This gap legal regulation can be eliminated by the adoption of the Law of the Primorsky territory. In this regard, the Duma has addressed to the Governor of Primorsky Krai Legislative Assembly a proposal on adopting the law of the Primorsky territory, providing for harmonization of redevelopment and reconstruction of the facilities with the authorized bodies of municipalities,» explained Elena Novitskaya. Deputies of the Legislative Assembly discussed the issue came to a conclusion about the feasibility of the adoption of such a law aimed at the security of the residents of apartment buildings, in which non-residential premises are re-planning and reconstruction.
