The story of Lazarus Rubinstein, who was the representative of the «okna rosta» company in Vladivostok, is increasingly developing in the judicial plane. Recall that a criminal in the activity of the Vladivostok office «Window Growth», the official representative of which was Fe Rubinstein, was revealed at the end of 2012 when more than 50 people have paid services in manufacture and installation of Windows and have not desired. Damage case — more than 8 million rubles, but the Lazarus Rubinstein managed to escape, presumably abroad. Several dozens of victims, without waiting for the active actions of the police themselves filed statements of claim in the district courts, demanding in court to terminate the contracts with Fe «Lazarus Rubinstein». Part of the problem of many citizens who suffered from the actions Rubinstein, was that the installation of Windows they took credits from the banks. The result — no Windows, and require banks to repay the loan. However, the one who took out loans, now they are trying to deploy the situation in the «initial state». Like, if banks know that we can take loans on the window and transfer the money, and not us, straight into ie «Rubinstein,» therefore, in the case of Bank fraud we do not pay — let it deals with Lazarus and the loan agreement may be considered not concluded. The most telling example: the recent trial in the appellate court of the Primorsky regional court (11 June 2013), where citizen K appealed the decision of the court of Savetski district, Vladivostok, which partially satisfied its requirements. In its decision, the court cancels the contract citizen K. Fe «Lazarus Rubinstein», but admitted that she must repay the loan, which took on a Windows installation. Being left dissatisfied with this decision, citizen K appealed the decision of the court of Soviet district in Primorsky regional court. But Primorsky regional court has not changed decision in this part: although the Treaty between K. and Fe «Lazarus Rubinstein» invalidated, give money to a Bank it will still have to, because the Bank is not a third party under this agreement. Consequently, the court practice on «Windows of Growth» in Vladivostok consists not in favor of those who have taken loans for Windows installations «from Rubinstein». Lazarus services not rendered, contracts terminated, but the «loan» money for unidentified window to give still have.
