The audit data for remote monitoring of forest land in a district of Svetlinsky district forestry Terneysky District Prosecutor\’s Office found that in this area illegally cut down trees spruce and fir species in the amount of 36 pieces. According to estimates, the total volume of illegally felled timber was about 11 m.
In this case, the Authority\’s preliminary investigation procedural check into the matter found that the illegal cutting of forest plantations has been made possible due to the employee branch of «Light» of «Maritime timber merchants» for the sight buttons because of the great pillars of snow, that is, in the absence of willful misconduct ( which excludes criminal liability).
Meanwhile, by virtue of Article 29 of the Forest Code, logging in excess of allowable cut (allowable exemptions wood) is prohibited, and legal entities shall harvest timber in accordance with the rules of timber harvesting on the basis of lease agreement.
Given these circumstances, against the director of the branch of «Light» of «Primorsklesprom» Terneysky District Attorney filed an administrative action under Part 1 of Art. 828 of the Code of Administrative Offences — illegal cutting of forest plantations.
As a result of its consideration of the said official administratively liable to a fine of 20 thousand rubles.
In addition, the district prosecutor appealed to the district court to Terneisky claim for recovery from the legal entity of «Primorsklesprom» the amount of environmental damage caused in excess of 60 thousand rubles.
